11. Summary of the new findings of the thesis:
First, theoretically. The thesis contributes to clarify a number of theoretical issues related to commercial lending, the risk of commercial banks and mortgages to mitigate this risk and the law on real estate mortgage. In order to limit risks in lending activities of commercial banks.
Second, in practice. i) The thesis has clarified the current real estate mortgage law in order to limit the risk in lending activities of commercial banks in Vietnam, showing the characteristics of subjects participating in mortgage relations. mortgage terms, content, the effect of the real estate mortgage contract in lending activities of commercial banks, the handling of real estate mortgaged at commercial banks. Limiting the risk to bank loans in Vietnam, protecting the interests of creditors - commercial banks. ii) The thesis has highlighted the advantages, limitations and inadequacies of the law and limitations in law enforcement of real estate mortgages to limit the risk of commercial banks lending in Vietnam; iii) Identify the main causes of these limitations.
